By downloading, installing, or using the Privam mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). Privam is developed and operated by Sayene, a brand of SayEnergy Sp. z o.o.
Important: If you do not agree to these Terms, do not use the App.
Privam is an AI-powered chat application that operates entirely on your device. The App:
No Data Collection: Privam does not collect, store, or transmit any personal data or conversation content. All processing occurs locally on your device.
Privacy Policy: Your use of the App is also governed by our Privacy Policy, available at privacy.html, which is incorporated into these Terms by reference.
The App uses Gemma AI models provided by Google. Your use of Gemma technology is subject to Google's Gemma Terms of Use, available at https://ai.google.dev/gemma/terms.
The free version displays non-personalized advertisements through Google AdMob, subject to Google's advertising policies.
Premium features are available through in-app purchases processed by Google Play Store or Apple App Store. All purchases are subject to the respective platform's terms and refund policies.
Refund Policy: Refunds for in-app purchases are handled by the respective app store (Google Play Store or Apple App Store) according to their policies.
The App and its content, features, and functionality are owned by SayEnergy Sp. z o.o. and are protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may not use the App:
Experimental Technology: Using the app User acknowledges and accepts that Privam is using experimental technology and side effects such as slow responses, increased device temperature, increased battery usage, unresponsiveness or app crashes may occur. Please refer to our FAQ for more information.
"AS IS" BASIS: The App is provided "as is" without warranties of any kind, either express or implied.
We do not guarantee that the App will:
AI responses are generated by machine learning models and may not always be accurate, appropriate, or reliable. Users should exercise their own judgment when using AI-generated content.
To the maximum extent permitted by law, SayEnergy Sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
This includes, but is not limited to, damages for:
In no event shall our total liability exceed the amount paid by you for the App in the twelve (12) months preceding the claim.
The App requires sufficient device storage and processing power to download and run AI models locally. Performance may vary based on device specifications.
We do not guarantee compatibility with all devices or operating system versions.
We may update the App and these Terms from time to time. When we do:
You are responsible for regularly reviewing these Terms to stay informed of any changes.
You may stop using the App at any time by uninstalling it from your device. We may terminate or suspend access to the App for violations of these Terms.
Upon termination:
These Terms are governed by the laws of Poland, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Poland.
These Terms are currently available in English. Additional language versions may be provided in the future. In case of conflicts between language versions, the English version prevails.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.
